Attendee Terms

Welcome to use PINE service (the “Service”), which is provided to you as an event attendee (the “Attendee” or “you”) by PINE Events, Inc.
The Application and the Services are provided by PINE Events, Inc. (reg. No. 7046468), registered at 160 Greentree DR STE 101, Dover, Kent, Delaware, 19904, USA (which may be referred to as "PINE", "we", "us", or "our").
PINE can be contacted by email: support@pine.events. This address can be used by Attendees to get in touch with PINE and receive assistance with any questions or issues related to the Application or Services.
An Attendee may participate in professional events (the “Event” or “Events”) arranged by organizers using the Service (the “Organizer”).
These terms (the “Attendee Terms”) apply to the legal relationship between the Attendee and PINE, when the Attendee uses the Service. When the Organizers use the Service to arrange Events, the legal relationship between them and the PINE is governed by the Organizer Terms.
The Attendee accepts these Attendee Terms as legally binding (the “Agreement”) by registering into the Service or by using the Service. The Agreement is therefore a contract, which creates legally binding terms between the Attendee and PINE when the Attendee uses the Service. The Attendee may not use the Service if he/she does not enter into an Agreement with PINE.
1. General Conditions
PINE reserves the right to change the terms of this Agreement at any time. PINE will notify the Attendee of any changes via email or through the Service, and the changes will take effect 14 days after the notification is sent. By continuing to use the Service after the changes are made, the Attendee accepts the revised terms as legally binding.
Only individuals (i.e., natural persons) may use the Service as Attendees. However, the use of the Service and acceptance of this Agreement is prohibited if (a) the Attendee lacks the legal capacity to enter into a contract, or (b) the Attendee is prohibited by law from using the Service. By creating an Account (the “Account”) and using the Service, the Attendee represents and warrants that they are legally qualified and entitled to enter into a binding legal Agreement with the PINE in accordance with all applicable laws.
2. Creating an Account
The Attendee may create an Account through the Service by providing the required information truthfully during the registration process. PINE may review the accuracy of the provided information at the time of registration.
The Attendee is solely responsible for any and all activities performed through the Account, as well as the safe use, maintenance, and confidentiality of their password and other Account details.
If the Attendee becomes aware of any unauthorized use of their Account, they must immediately notify us via email at support@pine.events.
3. License and Provision of Events
Under the terms and conditions of this Agreement, we grant the Attendee a personal, revocable, non-exclusive, non-sublicensable, non-assignable, and non-transferable license ("License") to download, install, and use the Service on a device that the Attendee owns or controls.
The Attendee agrees not to, and shall not permit any third party to:
Sublicense, redistribute, sell, lease, lend, or rent the Service.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code for the platform.
Copy (except for back-up purposes), modify, adapt, alter, improve, or create derivative works of the software or any part thereof.
Use PINE name, logo, or trademarks in any context without our prior written consent.
Use the Service or software to violate any applicable laws, rules, or regulations, or for any unlawful, harmful, irresponsible, or inappropriate purpose, or in any manner that breaches this Agreement.
Engage in any activity that interferes with or disrupts the Service.
The Attendee is permitted to use the Service to join and participate in Events hosted by the Organizers via the Service.
4. Services
PINE will send an email to Attendees whose contact information has been provided by the Organizer, containing a link that allows them to access the Event for for which they have pre-registered via the Application. The Attendee must connect using the email address provided by the Organizer.
The Attendees may continue to access the Event indefinitely after the Event ends, unless the Organizer decides to terminate access to the Content on the Event.
Depending on the options selected by the Organizer, the Attendee may also be able to access one or more of the following Services:

Event Program
Attendee Networking
Attendee Cards
Virtual Expo
Chat Channels
List of Exhibitors
Push Notifications
Activity Feed
Interactive Event Map
City Guide
Job Board
The Attendee is permitted to use their Account for future Events, including any subsequent Events. By doing so, the Application can provide personalized interactions to the Attendee based on their previous Event experiences.
At this time, the Attendees are allowed to use the Service without charge. However, PINE reserves the right to introduce fees for certain features or uses of the Service in the future.
If and when fees are introduced, the relevant payment information and available payment methods will be provided through the Service and this Agreement.
PINE offers technical support to the Attendees at the following address: help.pinetool.ai. This support is available to help Attendees flag any difficulties they encounter when using the Services.
PINE reserves the right to offer any other Services it deems appropriate and to determine the format, technical features, and resources that it considers most suitable for delivering these Services.
5. Rights and Responsibilities of the Attendee
In addition to the other obligations outlined in these Attendee Terms, the Attendee agrees to the following:
When using the Services, the Attendee must comply with these Attendee Terms, as well as all applicable laws and regulations. The Attendee is responsible for ensuring that their use of the Services does not infringe the rights of third parties or disrupt public order.
The Attendee is solely responsible for their use of the Application and Services.
The Attendee is solely responsible for his/her electronic devices, communication devices and other such devices and matters such as hardware condition, internet connection, antivirus, backup, and other similar issues.
The Attendee is responsible for their actions during Events and must act lawfully and truthfully at all times. The Attendee must also act in accordance with the rules and regulations of the Event.
The Attendee agrees not to engage in any activities that disrupt or interfere with the functioning of the Service or its servers or networks. This includes, but is not limited to, actions such as hacking, spamming, or overloading the system.
The Service may include links to websites owned and operated by third parties. The Attendee is responsible for their own actions when visiting these websites and any risks that may be associated with doing so.
The Attendee agrees to not use the Service to send, transmit, or store materials that are against good practice or the law, or to encourage others to do so. The Attendee also agrees to not violate anyone's intellectual property rights through the Service.
The Attendee agrees that PINE may share their personal data with the Organizer and Sponsors of the Event they are attending, as long as the Organizer allows the sharing of data with the Sponsors through the Service. PINE will provide the personal data to the Organizer and Sponsors because they have the right to use the data for their Events.
PINE owns and retains all intellectual property rights in the Service and its content, including trademarks, trade names, service marks, and copyrights. The Service contains copyrighted material and other proprietary information that belongs to PINE and its licensors. The user agrees not to copy, modify, transmit, create derivative works from, use, or reproduce any of this copyrighted material or proprietary information without first obtaining written permission from PINE. The user also agrees not to remove or alter any proprietary notices, such as copyright, trademark, and other intellectual property notices, that appear on any content.
If the Attendee does not follow the terms of this Agreement, PINE has the right to end the Agreement immediately, cancel the Attendee's account, and take any other necessary actions.
The Attendee is solely responsible for any content that they publish on the Application, including text, graphics, audio, audiovisual, and other types of content (collectively, "Content"). The Attendee understands that any Content they publish on the Application will be made publicly available and may be viewed by other users. The Attendee assumes all risks and consequences arising from the publication of their Content on the Application.
The Attendee confirms that they have read and understood PINE's Privacy Notice, including the provisions on data protection, and agree to its terms when using the Service.
6. Attendee Guarantee
The Attendee agrees to indemnify and hold PINE harmless from any complaints, claims, actions, or demands arising from the Attendee's breach of any of their obligations or warranties under these Attendee Terms.
The Attendee also agrees to compensate PINE for any damages incurred and to pay for any fees, expenses, or penalties incurred as a result.
7. Rights and Responsibilities of PINE
PINE is the administrator of the Service and is not responsible for the availability, redemption, marketing, or any other obligations related to the Events listed on the Service. PINE is also not responsible for any errors, reliability, damages, or other issues related to the Events. PINE is not responsible for the content or actions of the Organizers or Attendees of the Events, or for the activities of the Organizers or Attendees on the Service. PINE is not liable for any actions or activities of the Organizers or Attendees before, during or after the Events.
PINE shall not be liable for any accidents, damages, or crimes that may occur in connection with the Service. The Company is also not responsible for any direct or indirect damages that may arise from the use of the Service or the information and notices available through the Service. PINE is not liable for any damages or other disadvantages caused to the Attendee or third parties as a result of incorrect or insufficient user information.
PINE is not responsible for any losses that may occur as a result of the Attendee's use of the Service. The Attendee agrees to be solely responsible for any failure to comply with their obligations under this Agreement, including any resulting consequences.
PINE does not make any representations or warranties regarding the operation of the Service or any of its features, and does not guarantee that the Service will be free of interruptions or errors. PINE is not responsible for any damages to the Attendee or third parties that may result from the use of the Service, including technical defects, malfunctions, or malicious software, or from any third-party links or other causes. The Attendee understands that the Service is provided "as is" without any express or implied warranties.
PINE reserves the right to disable the Service or any part of it for maintenance, installation, modification, public safety, system overload, or any other similar reason. PINE may also terminate the provision of the Service (or any part of it) to the Attendee or to all Attendees, permanently or temporarily, at PINE's discretion and without prior notice.
The Service is provided on an "as is" and "as available" basis, without any express or implied warranties. This includes, but is not limited to, warranties or conditions of merchantability, fitness for a particular purpose, title, non-infringement, or those that may arise by statute or from a course of dealing or usage of trade. The Attendee understands that the use of the Service is at their own risk, and PINE is not responsible for any defects or errors in the Service.
The Service may allow you to access, communicate with, and interact with third-party sources, such as websites and services. PINE is not responsible for the content, actions, or practices of these third-party sources. Your interactions with these sources and your use of and reliance on any content provided by them is at your own risk and discretion.
PINE is not responsible for the accuracy or correctness of the content on the Service, except for content that is generated by PINE itself. PINE is not responsible for information that is disclosed by Attendees or Organizers through the Service, or for any other content on the Service.
PINE reserves the right to remove any material from the Service that has been reported or denied by PINE, or that PINE believes to be unlawful, against good practice, in violation of this Agreement, inappropriate, or erroneous. PINE may also remove material that is harmful to PINE, Attendees, or third parties, or that contains any legally questionable or offensive content that is inappropriate for the Service. The Attendee understands that PINE has the right to exercise this discretion as necessary to ensure the integrity and safety of the Service.
The Service collects anonymized data from the Attendee's use of the Service during the event, including but not limited to data generated through the Service's networking features (referred to as "Anonymized Usage Data"). PINE owns all rights, title, and interests in the Anonymized Usage Data and may use it for its own purposes. The Attendee agrees that PINE has the right to collect and use this data in this manner.
8. Limitation of Liability
PINE is not responsible for any inaccuracies or errors in the information, Attendee content, or listings available on or through this application. This includes any typographical errors or omissions related to text or photography. We make no representations or warranties of any kind, including regarding the accuracy, adequacy, usefulness, reliability, legality, or otherwise of the application. It is your responsibility to monitor any changes to the material and information contained in the application.
You accept full responsibility for the legality of your actions under applicable laws and the legality of any items you post in the application.
PINE, its directors, members, employees, and agents shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage, arising from or in connection with your use or inability to use the application. This includes, but is not limited to, any damages resulting from reliance on information obtained through the application or resulting from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance.
PINE shall not be liable for any damages, liability, or losses arising out of any transaction or relationship between you and another user or third-party service provider, whether or not PINE has been advised of the possibility of such damages.
The foregoing limitations of liability do not apply to the extent prohibited by law. Please refer to your local laws for any such prohibitions.
If any part of the warranty disclaimers or limitations of liability is found to be invalid or unenforceable for any reason or if we are otherwise found to be liable to you in any manner, then our aggregate liability for all claims under such circumstances for liabilities shall not exceed the total amount of payments made by you to PINE within one year preceding the claim.
9. Indemnification
You agree to indemnify and hold us and our affiliates, and our respective officers, directors, employees, and agents, harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including, but not limited to, attorney's fees) arising from:
(i) Your use of, or inability to use, the Service;
(ii) Your violation of this Agreement; and
(iii) Your violation of any third party right, including, without limitation, any intellectual property rights or data protection rights.
(ii) Your violation of this Agreement; and
(iii) Your violation of any third party right, including, without limitation, any intellectual property rights or data protection rights.
10. Prohibited Conduct
The following uses of the services are strictly prohibited:
Engaging in illegal, fraudulent, or infringing activities that harm the rights or security of third parties.
Violating public order or existing laws and regulations.
Hacking into the IT systems of third parties or any actions that seek to harm, control, interfere with, or intercept any part of a third party's information system, or violate its integrity or security.
Taking actions to improve the SEO of a third-party website.
Encouraging or aiding in any way the aforementioned prohibited activities.
Using the services for any purpose other than their intended design.
It is strictly prohibited for Attendees to copy and/or use, for their own purposes or the purposes of third parties, the concept, technologies, any part or all of the data, or any other component of the Application.
The following behaviors are also strictly prohibited:
Any behavior that disrupts, suspends, slows down, or prevents the continuity of the Service.
Any attempts to hack into PINE's systems.
Any hijacking of the Application's system resources.
Any actions that place an excessive load on PINE's infrastructure.
Any attempts to breach the security and authentication systems.
Any actions that could harm PINE's financial, business, or moral interests and rights.
Any violations of these Attendee Terms.
0.4 It is strictly prohibited to earn any income from, sell, or transfer any part or all of the access to the Services or Application, as well as any information hosted or shared on it.
11. Penalties for Breaches
In the event of a violation of any of the provisions of the Attendee's Terms, or any other laws and regulations by the Attendee, PINE reserves the right to take all necessary measures, including but not limited to:
Suspending, removing, or preventing access to the Services for any Organizer who has committed a violation or has been involved in one.
Deleting any Content related to the violation in question, either partially or in full.
Taking all appropriate measures and initiating legal proceedings.
Notifying the relevant authorities, if applicable, and cooperating with them to provide any information needed for their investigation and to suppress illegal or illicit activities.
If the Attendee breaches any of their obligations under these Attendee Terms, PINE may terminate these Attendee Terms immediately through written notification. In addition to any other consequences outlined in these Attendee Terms, this termination may occur.
12. Intellectual Property
The systems, software, structure, infrastructure, databases, codes, and other content (including text, images, visuals, logos, trademarks, and databases) used by PINE on the Application, excluding any Content belonging to the Attendee, are protected by intellectual property and database producer rights.
Any unauthorized dismantling, decompiling, decoding, extraction, reuse, copying, or other reproduction, representation, dissemination, or usage of any of these elements, in whole or in part, is strictly prohibited and may result in legal action.
The Attendee grants PINE an unlimited, perpetual, irrevocable, and non-exclusive right to use their suggestions or proposals for improving the Application, in any way or for any purpose.
By posting Content on the Application, the Attendee grants PINE a non-exclusive, worldwide, royalty-free right and license (including the right to sublicense) to host, store, transfer, display, run, reproduce, and modify all or part of such Content, in any format and through any channels currently known or hereafter developed.
13. Personal Data
PINE is committed to upholding data protection regulations, including the General Data Protection Regulation (the “GDPR”) of the European Union. To ensure compliance with these regulations, PINE has implemented a personal data protection policy, the details of which can be found in the Confidentiality Policy. Attendees are encouraged to review this document. PINE also ensures that any sub-processors (companies that they work with to provide services) follow appropriate technical and organizational methods to protect personal data and comply with the GDPR. These procedures are governed by contract provisions that adhere to GDPR requirements.
The App Attendee is aware and agrees to the sharing of their Account data and information regarding their participation in the Event with PINE. This information is necessary for the App to function and facilitate the sharing of content and professional networking among attendees before, during, and after the Event.
14. Links and third-party websites
PINE cannot be held responsible for the technical availability of websites run by third parties (including partners) that the Attendee may access through the Application.
PINE is not responsible for the content, advertisements, products, and services available on these third-party websites, and attendees should be aware that these sites are governed by their own terms and conditions.
As a networking platform, PINE is not responsible for any relationships that may occur between Attendees, Companies, Organizers, and any other third parties, including advertisers, professionals, or salespersons, who may be connected through the App. PINE will not be involved in any disputes between these parties, including those related to Event participation, guarantees, declarations, or any other obligations.
15. Advertising
PINE, in collaboration with the Organizer, reserves the right to include advertising and promotional messages on any page of the Application and in any communication with the Attendees, in a format and under conditions determined solely by PINE.
16. Amendments
PINE reserves the right to amend these Attendee Terms at any time.
Attendees will be informed about these amendments through appropriate means.
Attendees who do not agree to the amended Attendee Terms must unsubscribe from the Services using the procedure described in Clause 9, "Length of Services and Unsubscribing".
Any Attendee who continues to use the Services after the amended Attendee Terms have taken effect is deemed to have accepted the amendments.
17. Term and Termination
Termination by PINE: PINE reserves the right to modify, suspend, or discontinue the Application, content, features, or offers at any time, without notice. PINE also reserves the right to offer or cancel opportunities for some or all the Attendees of the Application at its sole discretion. You agree that PINE shall not be liable to you or any third party for any such modifications, suspension, or discontinuance.
In the event of a suspected or alleged violation of these Attendee Terms, PINE reserves the right to take any lawful actions it deems appropriate, including suspending or terminating your access and/or Account. PINE may also cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong.
Termination by Attendee: The Attendee may terminate this Agreement with PINE at any time by deleting your Account and ceasing to access or use the Application. Upon closing your Account, all licenses granted under these Attendee Terms will immediately terminate. PINE may delete all data associated with your Account and activity from its servers without liability or obligation to you.
18. Governing Law and Disputes
This Agreement and the relationship between the Attendee and PINE shall be governed by and construed and interpreted in accordance with the laws of the United States of America without regard to its principles and rules on conflict of laws.
If the Attendee has a dispute with the Organizer, the Attendee has to settle the dispute with the Organizer itself.
Disputes arising from the Agreement shall primarily be settled through negotiations. Secondarily, Attendee may seek to settle disputes arising from this Agreement in the appropriate court in the United States of America having jurisdiction over the matter.
